1)        JLMBC Update

Cole provided a written report from the JLMBC Committee Meeting

2)        Hiring an additional Law Firm

The Board discussed having available a second law firm – as needed – but without a retainer agreement. Motion by Winslow: To hire Fink and Steinberg as additional counsel. 2nd by Fuchs

In favor: Winslow, Fuchs, Rosenthal, Embry, Bobo, McTeague, Geller.
Against: Lambert, Cole.

Motion Passed

3)        PAC

Motion by Embry to set the rate to fund the PAC account at $2.25 per pay period, per member. 2nd by Cole.

In favor: Unanimous

4)        Various LACAA matters (Non-Confidential update)

     1)  Unfair (by Cole) – Refusal to provide information re complaint.

     2)  Volunteer attorney contracting out matters. This was denied by the Office. Decision: Move to arbitration – a way for additional documents to be discovered relating to the volunteer program.

     3)  Arbitration regarding involuntary transfers. On 11/23 it is set to select an arbitrator.

     4)  Next Tuesday is the meet and confer regarding furlough exemptions.

     5)  Retiree writ: There is a status conference the end of August. Briefing is due in March. EAA filed notice to intervene (Judge Lavin, Dept. 92) EAA moved on behalf of the Confidentials. EAA attempted to intervene ex parte but that made Judge Lavin upset – denied their ex parte application. They will be filing their motion.

     6)  12(b)(6) Motion – Impairment – made reference to 26F meet & confer documents.

     7)  2nd Tier: City does not believe this is a meet and confer issue. The Union believes it is.

     8)  The 1.75% cash payment is due any ime between 11/1 and 12/31.


As you know, our new MOU includes annual reimbursement for MCLE-related expenses. To ensure that you receive complete and timely reimbursement, we encourage you to follow the instructions contained in the MCLE protocol provided by City Attorney Management. You must complete and submit a reimbursement form in order to receive reimbursement.

You can reimburse expenses related to attending MCLE programs that are accepted by the California State Bar, even if the program takes place in another state. Eligible expenses include the cost of the program, travel, and per diems.

Please be judicious when choosing lodging and which food/drink expenses you submit for reimbursement.

The Board is pleased to announce that LACAA has retained the law firm of MASTAGNI, HOLSTEDT, AMICK, MILLER & JOHNSEN as General Counsel.
